FEDERAL “BAKER ACT”—Involuntary Commitment and Mental Health Screening Bill in Congress

Ever heard of Murphy’s Law?  Well, this is Murphy’s Bill and if anything can go wrong it will!  Take a look:

MORE THAN 29 MILLION A YEAR, OF OUR TAX PAYER DOLLARS, IS BEING PROPOSED TO GO INTO ENFORCED MENTAL HEALTH TREATMENT FOR ALL AGES ALL THROUGHOUT THE U.S.

There is a bill in Congress RIGHT NOW that will most assuredly speed up the implementation of the mental health programs called for in the new Federal Health Law and in addition will promote the use of ENFORCED MENTAL HEALTH TREATMENT AND COMMITMENT, FROM STATE-TO-STATE.

This bill targets all babies, children and teens!

Creating national awareness about mental illness using social media and promoting to children in school

Training program for doctors to train them to give psychological evaluations to:

-infants 12-36 months

-preschool children

-screening for autism in preschoolers

(example of questions: . If you point at something across the room, does your child look at it? Yes N

(FOR EXAMPLE, if you point at a toy or an animal, does your child look at the toy or animal? Yes No

Does your child play pretend or make-believe? (FOR EXAMPLE, pretend to drink Yes No

from an empty cup, pretend to talk on a phone, or pretend to feed a doll or stuffed animal?)

-Children & teens

-any area determined to be applicable by the Assistant Secretary of the mental health office in Washington

-how to use these screening tools in their offices

-how to spot when a behavioral health problem exists

All ages-Enforced treatment

Enforced Outpatient Treatment/Court ordered for individuals who have been incarcerated, have a history of violence or have had “medically unnecessary hospitalizations and anyone potentially a danger to themselves or others, homeless people, people with a “mental health history”.

Training Correctional & Law Officers to spot mental illness and intervene

Drug testing, mental health treatment and alternative to incarceration for those who violate laws & veterans who have broken a law and were discharged by the military under conditions other than dishonorable. Instead of jailing them, they are going to be drugged.

Federal Involuntary Commitment Criteria that is more LOOSELY DEFINED AND MORE ENCOMPASSING than our state criteria

2 EXAMPLES OF THIS LOOSER AND BROADER CRITERIA AND HOW IT IS OPEN TO INTERPRETATION BY THOSE IMPLEMENTING THE COMMITMENT

(persistently or acutely disabled is defined as If not treated, the illness has a substantial probability of causing the individual to  suffer or continue to suffer severe and abnormal mental, emotional, or physical harm that significantly impairs judgment, reason, behavior, or capacity to recognize reality’.

This could be determined on a subjective basis by the “authority” making the adjudication.

The illness substantially impairs the individual’s capacity to make an informed decision regarding treatment, and this impairment causes the individual to be incapable of understanding and expressing an understanding of the advantages and disadvantages of accepting treatment and understanding and expressing an understanding of the alternatives to the particular treatment offered after the advantages, disadvantages, and alternatives are explained to that individual.

This could be an individual who doesn’t want psychiatric treatment.

The plan is to spend $29,738,000 for each of the fiscal 24 years 2014 through 2018.

It will take more volunteers and more members to keep up with the amount of work and the speed at which we will now have to work to halt harm & abuse in the field of mental health.
